1. Acceptance of Terms

Welcome to Nightvent. By accessing or using our platform at nightvent.app ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Nightvent ("we," "us," or "our"). Please read them carefully before using our Service.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility & Account Requirements

2.1 Account Creation

To use Nightvent, you must:

• Provide a valid email address
• Create a secure password
• Verify your email via OTP (one-time password)
• Select your gender (for matching preferences)
• Agree to these Terms of Service and our Privacy Policy

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

2.3 One Account Per Person

You may only create one account. Creating multiple accounts to evade bans or abuse the Service is strictly prohibited and will result in permanent termination of all associated accounts.

3. Acceptable Use Policy

Nightvent is designed to provide a safe, anonymous space for respectful conversations. You agree to use the Service in compliance with all applicable laws and these Terms.

3.1 Allowed Use

• Respectful, honest conversations
• Venting emotions and sharing thoughts
• Providing emotional support to others
• Using the Service as intended (anonymous 1-on-1 chat)

3.2 Prohibited Use

You may NOT use Nightvent to:

Violation of these rules may result in warnings, temporary suspension, or permanent account termination, depending on the severity of the offense.

4. Service Features & Limitations

4.1 Anonymous Matching

Nightvent connects you with random users for anonymous 1-on-1 text conversations. Each match generates unique, temporary aliases (e.g., "User-1234"). Your real identity is never revealed to your chat partner.

4.2 Gender Preference Filters

You may filter matches by gender preference (Any, Male, Female). This is a preference, not a guarantee. Match availability depends on users currently in the queue.

4.3 Skip & End Chat

You may skip your current partner or end the chat at any time. No explanation is required. Your partner will be notified that the chat has ended.

5. User Responsibilities

As a user of Nightvent, you are responsible for:

• Your own conduct and the content you share during chats
• Treating other users with respect and kindness
• Reporting violations of these Terms when you encounter them
• Understanding that Nightvent is not a substitute for professional mental health services
• Seeking professional help if you are experiencing a mental health crisis

6. Enforcement & Moderation

6.1 Report System

If you encounter a user violating these Terms, you may report them using the in-app report feature. Provide a reason for the report (harassment, spam, inappropriate content, etc.).

Note: Because we do not store chat messages, we cannot review conversation history. Reports are evaluated based on metadata, patterns of behavior, and user history.

6.2 Investigation & Enforcement

We investigate reports on a case-by-case basis. Enforcement actions depend on the severity and frequency of violations:

• Warning: First-time minor violations may result in a warning
• Temporary Suspension: Repeated or moderate violations may result in temporary account suspension (7-30 days)
• Permanent Ban: Severe violations (harassment, illegal content, hate speech, sexual content, ban evasion) result in immediate and permanent account termination

6.3 No Appeals

Ban decisions are final and cannot be appealed. We do not reverse permanent bans except in cases of clear technical error. Do not create new accounts to evade bans; doing so will result in immediate re-ban.

7. Account Termination

7.1 Your Right to Delete

You may delete your account at any time through the in-app account settings. Account deletion is immediate and irreversible. All associated data will be permanently removed from our systems.

7.2 Our Right to Terminate

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms of Service
• Suspected fraudulent, abusive, or illegal activity
• Prolonged inactivity (accounts inactive for 12+ months may be deleted)
• Operational or legal reasons

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees of uptime, availability, or uninterrupted access
• Guarantees of match quality, compatibility, or user behavior
• Guarantees that the Service is free from errors, bugs, or security vulnerabilities

You use the Service at your own risk. We do not warrant that the Service will meet your expectations or requirements.

9. Limitation of Liability

To the fullest extent permitted by law, Nightvent and its operators shall NOT be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Emotional distress or psychological harm resulting from conversations with other users
• Actions or conduct of other users (harassment, misinformation, harmful advice, etc.)
• Service interruptions, downtime, or technical failures
• Unauthorized access to your account due to compromised credentials

Your sole remedy for dissatisfaction with the Service is to stop using it and delete your account.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nightvent and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms of Service
• Your violation of any third-party rights (privacy, intellectual property, etc.)
• Your conduct during chats or interactions with other users

11. Intellectual Property

11.1 Platform Ownership

All content, features, functionality, code, design, and branding on Nightvent (including but not limited to text, graphics, logos, icons, software) are owned by Nightvent and protected by copyright, trademark, and other intellectual property laws.

11.2 User Content

You retain ownership of the messages you send. However, since we do not store chat messages, we do not claim any rights to your content. Once your chat ends, your messages are permanently deleted.

11.3 Restrictions

You may not:

• Copy, modify, or distribute the Service's code or design
• Use the Nightvent name, logo, or branding without permission
• Create derivative works based on the Service

12. Changes to the Service

We reserve the right to:

• Modify, suspend, or discontinue any feature of the Service at any time
• Introduce new features, including premium subscription features
• Change pricing or introduce fees for certain features (with advance notice)
• Update the Service without prior notice

13. Governing Law & Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with international principles of contract law, without regard to conflict of law provisions. As a global service, we do not designate a single jurisdiction's laws to govern these Terms.

13.2 Dispute Resolution

In the event of any dispute arising from these Terms or your use of the Service, you agree to first attempt to resolve the matter informally by contacting us at support@nightvent.app. If informal resolution fails, disputes shall be resolved through binding arbitration or mediation, as mutually agreed upon.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
